Acceptance of Terms

By accessing and using the services provided by TechNavigator GmbH ("TechNavigator", "we", "our", or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. These terms apply to all visitors, users, and others who access or use our wellness services and facilities.

Service Description

TechNavigator provides wellness services including but not limited to:

• Personal fitness training and coaching
• Yoga and mindfulness classes
• Nutrition coaching and guidance
• Wellness assessments and consultations
• Group fitness classes and workshops
• Access to wellness facilities and equipment

User Obligations

By using our services, you agree to:

• Provide accurate and complete information about your health status and fitness goals
• Follow all safety guidelines and instructions provided by our staff
• Respect other clients and maintain appropriate behaviour in our facilities
• Arrive on time for scheduled appointments and provide adequate notice for cancellations
• Pay all fees and charges in accordance with the agreed payment terms
• Not use our facilities or services for any unlawful purpose
• Comply with all applicable laws and regulations whilst using our services

Health and Safety

You acknowledge that participation in fitness activities involves inherent risks. You represent that you are in good health and have no medical conditions that would prevent safe participation in our wellness programs. You agree to immediately inform us of any changes to your health status. We recommend consulting with a healthcare provider before beginning any new fitness program. You participate in all activities at your own risk.

Payment Terms

Payment for services is due as specified in your membership agreement or service contract. We accept various payment methods as indicated during booking. Late payment may result in suspension of services. All fees are non-refundable unless otherwise specified in writing. Prices are subject to change with reasonable notice.

Cancellation and Refund Policy

Appointment cancellations must be made at least 24 hours in advance. Late cancellations or no-shows may incur charges. Membership cancellations must be provided in writing with appropriate notice as specified in your membership agreement. Refunds are provided only in exceptional circumstances and at our sole discretion.

Intellectual Property

All content, materials, and intellectual property associated with TechNavigator services, including but not limited to workout programs, nutritional guidance, educational materials, logos, and branding, are owned by TechNavigator or our licensors. You may not reproduce, distribute, modify, or create derivative works from our intellectual property without express written permission.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, TechNavigator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services. Our total liability to you for all claims shall not exceed the amount you have paid to us in the twelve months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless TechNavigator, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these terms or your use of our services.

Governing Law

These terms shall be interpreted and governed by the laws of Austria, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Salzburg, Austria.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these terms. Upon termination, your right to use our services will cease immediately. All provisions of these terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of these terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
